Scope and Content: Files of notes and summary reports relating to ‘civil bills’ or civil cases involving Fawsitt. One file is specifically marked ‘Civil Bills’, while two further files containing similar matter have also been placed here. (i) file marked ‘ Civil Bills’ containing rough notes on and of advices for various cases involving civil bills. Apparently prepared in the course of Fawsitt’s legal work, some of the material may also be study matter. Generally undated. Includes documents referring to the following cases: Rochfort v Heany; Barry v Weiner [1932]; The S.I.T. Ltd; Cropper v Curran (1932); Patrick Stanley, British Legion, Kingstown Branch; National City Bank v Kathleen Garland (1931); John Glennon, Drumcree; Dental Board v Hutton [1930]; Sisk v Cronin and Cronin (1928); Hirdes v The Perfecta Cap Co [1928]; O’Connor v O’Sullivan; McCarsley v Brady (1929); Thompson v Berkerry; Galway County Council v Connemara O. Co.Ltd; Fawsitt v Callender [1929]; P Tierney & Son v M Gallagher & Sons [1929]. Notes not clearly referring to a case or matter placed at back of bundle. (ii) File of civil bill-related matter, in printed case file cover from the firm of Little, O hUadhaigh & Proud, Solicitors. It is not clear whether the matters concerned involved this firm, or whether the file cover was simply used for convenience. Reference is made to the following cases: Ryan v McWeeney (Monument Creamery v The Monument Dairy); Godfrey v Motorways express Ltd (1932); National Union of Railwaymen v Great Southern Railways; Egan v William Egan; Attorney General v Balbrina McGrath, Central Criminal Court, murder trial, commenced 27 February 1934 [*NOT a civil bill]; draft indenture between Michael S Walsh, Dublin, and his wife, regarding hereditaments; Sullivan v Kerry County Council (1933); Kohler v Kohler (1933); Donegan to O&M; 3 single pages containing parts of opinions by Fawsitt apparently on distinct civil bills. Also present are the following: Wigoder and Others v Wigoder, rough note of costs; rough note regarding amount to be paid by plaintiff in discharge of a claim; Notes, The Workmen’s Compensation Bill, 1932; Notes, Policies of Assurance Act; note, Notice to Advert in a matter; Note referring to a matter involving charterers [of a boat] and the skipper; rough note on a property matter; Note, a draft objection in a property matter; rough note on a property matter. (iii) File, also originally with Little, O hUadhaigh & Proud cover, containing further civil bill and other case and legal matter. The files seems mainly to consist of rough notes on civil cases, with most not named or dated. Some perhaps unrelated matter found in this file includes the following: Draft will of Diarmaid Fawsitt giving all his property to his wife (undated); ts ‘Provisional Suggestions for Applications under Section 36 of the Land Act, 1931’; Fees due, D Fawsitt BL, Trinity Term, 1932; letter, Fawsitt to Sean (James )’Connor & Co, Solicitors) re Costello v Lenihan (11 June 1932); blank postcard comprised of printed enquiry form, directed to Butterworth & Co, Publishers, for details of The English and Empire Digest.

Scope and Content: Small file of loose matter not clearly fitting into other files in Section 6 of the collection. Includes the following: 1. Rough note book including notes eg ‘Joint Defendants: negligence’ and case Lynch v Deering. [Cover warped, pages loose] 2 . Rough note of Fawsitt’s costs , Claim of MJ Doyle, Doyle versus McCracken, Co Dublin Bye-Election December 1930. (2 April 1931). 3 . Cover note for cheque from W Mc A McCracken, dated 23 April 1931. 4 . D Fawsitt BL Account of Fees due in several cases, 27 May and 27 July 1932. 5 . Copies of Emergency Powers (No 166) Order, 1942, third and fourth amendment orders, 1942, issued under the seal of the government by Taoiseach Eamonn de Valera. [see PR81/1/6/E/12-13] 6 . Voting Paper, General Council of the Bar, 31 October 1930 7 . Note of two volumes of law books [for purchase/sale]. Dated 17 December 1928. 8 . Notes of names and amounts of money, list including ‘Library Fee’, on reverse Bewley’s Oriental Cafes printed price list.
