764 RECORDER'S OPINION RESPECTING THE ELDEST SONS OF FREEMEN.
from said French's quay to said small house quay, and containing 8! feet in breadth at the West side, and to end in a point at the East side, provided a public quay of 36 feet wide be left open to said River Lee from said West to said East side, and of the length of 210 feet, said liberty to remain to said Devonshire, Falkiner, Gordon, Carleton, and Mills, their heirs, &c., for 999 years, said Devonshire, &c., paying the Mayor, &c., of this City the yearly rent of one shilling during said term. Ordered, that Ald. Busteed do erect a new spit opposite the fort, and erect the old spit opposite the lower part of Cove, same to be paid out of the revenues of the Corporation. Present--Mr. Mayor, Sher. Fitton and Morrison; Alden. Jackson, Owgan, Busteed, Harding, Bury, Wetherall, Wrixon, Philpott, Crone; Mr. Will- cocks, C. S., Ald. Swete and Winthrop. 21 Aug., 1762. Recorder's opinion regarding the Eldest sons of Freemen was read : " I am of opinion that the eldest son of a freeman, merely as such, has not a right to his freedom during the life of his father, but must wait till his death to succeed him, as in the case of a descendible freehold estate ;" ordered, that ·this opinion be filed in the Town Clerk's office, for perusal of the freemen at large. That the Mayor, &c. pass his receipt for such musquets, bayonets, and hangers as he shall receive from the keepers of H. M. stores for the use of the Militia, and that the receipt of Timothy Hughes, the City Armourer, shall be sufficient for such as shall be lodged by the Mayor in the City Armoury. That the Corporation Gallery in St. Paul's Church be painted, and that Mr. C. S. do oversee same. 'X That £46 9s. 5d. be paid Ald. Hodder for one gold box and three silver boxes; It., £36 8s. 5d. to Richard Whitney, gunsmith, for cleaning part of the Militia arms; It., £9 15s. to Timothy Hughes, ironmonger, for iron work ; It., £17 13s. 7 !d. to Mr. Edw<'. Browning, for one year's English and ~rish Newspapers and votes of the House of Commons. That Ebenezer S~rgent buy 130 barrels of coal.
